What is birth injury and when can you claim compensation?

You may be entitled to claim compensation if there were mistakes in the medical care you received, leading to birth-related injuries to the baby, or injuries to the mother while giving birth.

Birth-related injuries

  • delay in delivery causing oxygen deprivation and severe neurological damage
  • failure to diagnose or treat low blood sugar (hypoglycaemia)
  • surgical or instrumental damage to the mother and/or baby
  • Erb’s Palsy (obstetric brachial plexus palsy)
  • Cerebral Palsy
  • Group B strep infection to the newborn
  • delay in diagnosis and treatment of Jaundice and Kernictus

Mothers injured when giving birth

The impact of medical mistakes during labour can be both physical and emotional. You may be experiencing ongoing problems including:

  • Perineal damage
  • Incontinence
  • Psychological damage

The aftermath of birth injury can be traumatic and bewildering. Our specialist team are here to help you get the practical support you need, as well as advising on whether you have a claim for compensation.

Generally, claims should be made within three years from the date you or a loved one suffered medical negligence (although there are exceptions, such as in the case of children where the three-year limit doesn't start until after their 18th birthday).

How can birth injury compensation help you and your family?

Our starting point with birth injury compensation is that the settlement should significantly improve your day to day life and make a real difference for your family. This means securing funds to cover any medical and additional care needs, now and in the future.

Making a birth injury claim can also be about recognising the impact this has had on your family. It gives you a chance to ask questions about what happened and provide some justice, as well as helping ensure lessons are learned so others don’t go through the same experience.

"My partner and I suffered immeasurably when our little girl sustained an avoidable birth injury."

"We struggled to understand what went wrong and what the future might look like, however Tozers made light the load. No stone was left unturned when explaining what may or may not come into fruition."

"They helped us battle for the answers our little girl deserved. For that, we are eternally grateful as we can now move on with our lives."
