Retained EU Law (Revocation and Reform) Bill
The Retained EU Law (Revocation and Reform) Bill ends the supremacy of EU law on 31 December 2023. Anything which happens from 1 January 2024 will be judged on the basis of the wording of UK law, which will no longer have to give way to EU law.
Statutory Code on dismissal and re-engagement ‘Fire and re-hire’
The government announced earlier this year that a new statutory code on dismissal and re-engagement will be published. Government consultation ended on 18th April 2023, and it is expected that the results will be published soon. The draft code sets out employers’ responsibilities when seeking to change employment terms and conditions, requiring employers to consult with employees in a fair and transparent way. The code will allow the tribunals to apply an uplift of 25% on compensation where the code applies and has not been followed.
Contractual right to bank holidays
There was an extra bank holiday on 8th May 2023 to mark the coronation of King Charles III. Anyone who has a contractual right to bank holidays and has been off this year on sick leave, Maternity, Adoption or Shared Parental Leave may be permitted to carry over that extra day. Fentem v Outform EMEA Ltd 2022
A case that has been heard by the Court of Appeal, but we have not yet had the decision. This case centres on the issue of whether an employer with a PILON clause in a contract of employment can unilaterally bring a resignation date forward and it still remain a resignation.
