What if a dispute has arisen between me and a leaseholder?

Where problems arise between a landlord and leaseholder, it is important that you as the landlord obtain timely legal advice to ensure that lease breaches are not “waived”, and the correct notices are served at the correct time at the right address.

 

What are service charge disputes?

These are common and usually arise because the leaseholder has not paid the service charge in spite of various written requests. There is often an underlying reason for the leaseholder failing to pay the service charge such as:

  • The service charge is not for a reasonable amount
  • There has been a lack of consultation
  • There has been a failure to provide information
  • The requests to pay are not valid demands

We can provide advice on resolving these disputes and, where the dispute cannot be resolved easily, advise you on the next steps including serving formal notices, liaising with the mortgage lender and, as a very last resort, tribunal, or court proceedings.

We offer competitive fixed fees for standard warning letters and Notices and, where we are instructed regularly, can offer scaled fees for Property Managers.
