Otherwise known as misrepresentation claims, these arise where someone is induced to enter into a contract by some false statement of fact (or law) which was made with the intention that they should rely on it.
Misrepresentations may be actionable whether fraudulent, negligent or even entirely innocent.
Prompt action is important in such cases because often there is a right to rescind – tear up – the contract and claim the money back. Damages are generally available in addition to or instead of rescission.
